Terms and Conditions and Participant Agreement

By participating in any programs or services offered by EmpowerHER Health and Fitness, clients acknowledge they have read, understood, and agree to abide by the following terms and conditions:

  1. Assumption of Risk
    Participants in programs offered by EmpowerHER Health and Fitness, including but not limited to strength and conditioning training and high-intensity workouts, acknowledge the strenuous nature of these activities. Participants understand and accept the inherent risks, including potential injury or death, associated with such activities. EmpowerHER Health and Fitness is not liable for injuries resulting from negligence, equipment malfunction, or personal health conditions.

  2. Waiver and Release of Liability
    Participants agree to waive any liability claims against EmpowerHER Health and Fitness, its employees, coaches, and volunteers for injuries or damages that may arise during or as a result of participation in our programs. Participants accept financial responsibility for any injuries caused by their negligence and indemnify EmpowerHER Health and Fitness from liability for injuries to themselves or others.

  3. Payment Terms and Memberships

    • All payments for services are to be made in advance and processed securely through Stripe or another designated method.

    • Payment is required in full before the commencement of any service or program.

    • Memberships are billed monthly on the 1st of every month.

    • If a client has paid in full for 3, 6, or 12 months, billing will recommence on the 1st of the month following the end of that period, repeating the last payment plan unless the client provides notice.

    • If a membership starts or ends mid-month, a pro-rata payment will be taken to align the membership billing with the 1st of the following month.

    • All payments are non-refundable, and no refunds will be issued for cancellations, missed sessions, or any other reasons.

    • EmpowerHER may implement a yearly price increase, which will be communicated to clients in advance.

  1. Cancellation Policy and Hold Requests

    • Clients must provide 31 days' written notice via email to cancel any membership or program.

    • Once notice is provided, one final full payment will be taken before cancellation becomes effective.

    • If notice is given, for example, on the 15th of the month, they will still be responsible for the full payment on the 1st of the following month.

    • Memberships can only be put on hold for extenuating circumstances, incurring a £30 fee per month. Holds are only allowed with a definite start and end date. If a membership is cancelled while on hold, the 31-day notice period still applies.

    • Clients have full control over cancelling their membership and payments, but they must provide the required 31-day notice period for any cancellations to take effect.

    • All monthly memberships require a minimum 3-month commitment, with 31 days' notice required to terminate.

    • Participants joining under a Body Confidence Program, Kickstart, or other programs will automatically transition to our Unlimited Membership at the end of their program. If you do not wish to continue, you must inform us no less than 14 days prior to the program's end. This is the only exception to the 31-day notice period. There will be an option to choose a different membership plan at the end, but if no action is taken, the plan defaults to Unlimited Membership.

    • Our Unlimited Membership includes up to 5 Group PT sessions per week. Yoga, abs, and other specialised classes are not included in this count.

    • Our Limited Membership includes up to 3 classes per week. Each class, including a 15-minute abs session, counts as one session credit.

  2. Cancellation Policy for 6-Month and 12-Month Payment Plans

    • Clients must provide 31 days' written notice via email to cancel any membership or program.

    • After notice is provided, one final full payment will be taken before the cancellation becomes effective.

    • If notice is given, for example, on the 15th of the month, clients will still be responsible for the full payment on the 1st of the following month.

  3. Early Termination Fee:

    • Early Termination Fee for 6 & 12 Month Memberships:

    • If Less Than 50% of the Plan is Completed:
      If less than 50% of the payment plan term has been completed, 31 days' notice is required, and a £200 early termination fee will apply. Once notice is given, one full payment will be due, plus the £200 early termination fee.

    • If More Than 50% of the Plan is Completed:
      If more than 50% of the payment plan term has been completed, 31 days' notice is required, and a £100 early termination fee will apply. Once notice is given, one full payment will be due, plus the £100 early termination fee.

  1. Use of Services
    Clients are responsible for ensuring they have the necessary physical fitness and health to participate in programs. Clients must adhere to all rules and regulations set forth by EmpowerHER Health and Fitness for safe and effective use of its facilities and equipment.

  2. Personal and Group Session Cancellation Policies

    • For 1:1 coaching sessions, clients must provide 48 hours' notice to cancel or change an appointment. Failure to do so will result in the forfeiture of that session.

    • For group sessions, clients must provide 2 hours' notice to cancel. Failure to do so will result in the forfeiture of that session credit.

    • Clients enrolled in small group personal training (SGPT) have fixed hours and set times for their sessions, which cannot usually be changed. If a client is unable to attend a scheduled SGPT session, the session will be forfeited, as alternative times are not guaranteed.

  3. Privacy and Use of Media
    Clients consent to the use of their photographs, videos, or likeness for promotional purposes by EmpowerHER Health and Fitness. This consent is irrevocable once media featuring the client has been used. For further details on how we handle and store personal information, refer to our Privacy Policy, updated as of 5th August 2024 in accordance with GDPR regulations.

  4. Intellectual Property
    All content provided by EmpowerHER Health and Fitness, including written materials, videos, images, and logos, is protected by copyright and other intellectual property laws. Clients may not reproduce, distribute, or modify any content without prior written permission.

  5. Complaints Procedure
    At EmpowerHER Health and Fitness, we strive to provide excellent service to all our clients. If you have a complaint, we encourage you to follow our complaints procedure outlined below:

  • Please submit your complaint via email to info@empowerherhealthandfitness.co.uk

  • We will acknowledge receipt of your complaint within 48-72 hours of receiving it.

  • Your complaint will be investigated promptly and thoroughly by our team. We aim to resolve all complaints as quickly as possible, usually within 21 days.

  • Once the investigation is complete, we will inform you of the outcome and any actions taken to resolve the issue.

  • If you are not satisfied with the resolution provided, you may request that the complaint be escalated to a senior member of our team. They will review the matter and provide a final response.

  • All complaints and their resolutions will be documented and retained for internal review and improvement purposes.
